ASADA gets own advice on Lachie Whitfield case

ASADA has received legal advice from a QC on the case against Lachie Whitfield and two former Giants officials for allegedly hiding the player from drug testers.

The legal advice means the drugs body is briefed to consider its own independent move on the trio if the AFL does not lay charges.

The league conducted a lengthy investigation into Whitfield, former football manager Graeme Allan – now the head of Collingwood's football program – and former welfare manager Craig Lambert, who is now at the Brisbane Lions, and received legal advice.

The AFL presented its findings to ASADA in August. The drugs body referred the matter back to the AFL and requested the league get legal advice on possible charges.

It has now emerged that ASADA then sought legal advice from a senior counsel in Sydney about the case against the trio.

The AFL has received legal advice and is deciding whether to lay charges of avoiding a performance-enhancing drugs test, which brings a mandatory minimum four-year penalty. The news that ASADA has sought legal advice separate to the AFL indicates it was preparing for the possibility of acting regardless of the AFL.

In the Essendon doping case ASADA appealed to the Court of Arbitration for Sport when doping charges brought by the AFL were dismissed by the AFL's anti-doping tribunal. The CAS found the 34 past and present Essendon players guilty and imposed a two-year ban.

The move by the drugs body to seek independent advice does not necessarily mean it is planning to take action if the AFL does not act or the charges are dismissed in a tribunal, but does suggest it considered the findings of the AFL investigation and felt there was a case to answer.

The AFL has investigated claims Whitfield allegedly hid at Lambert's house on orders from Allan to avoid being drug tested.

It is understood Whitfield claimed to have taken an illicit substance and club officials were worried the drug could have been contaminated with a performance-enhancing substance.

Collingwood pair Lachlan Keeffe and Josh Thomas had just been banned for two years after testing positive to a performance-enhancing drug they said they had unintentionally taken when it was cut in an illicit drug they had taken.

Incriminating text messages Whitfield, Lambert and Allan and between Whitfield and his then girlfriend are the basis of the case against the trio.

Allan also deleted text messages from his phone and told a staff member to delete an email the club was sent by Whitfield's girlfriend about the alleged drug use and moves taken to avoid drug testing.

The AFL has not seen ASADA's legal advice. The league executive recently considered their own legal advice and the case against the player and the two officials.

The AFL has been in constant dialogue with officials from ASADA about the case.

If not ..... it has nothing to do with Eddies decision making.


Gubby made full disclosure prior to his appointment.

Don't see why people are getting all hysterical about this. If he gets a ban he gets a ban, and that's a big IF. It'll hardly bring the club to its knees.

Collingwood/Eddie could made to look Pretty Stupid.

With the More Talk that Allan will get a Ban of at Least 6 Months.

Better have something set up in case it Happens.

Allan has started to Pull Down what he wants changed but looks like he won't be able to Fix It Now

Pretty disappointed as obviously we desperately need someone like Grubby's influence, but you're right... it is going to end badly and we all know who's to blame for not doing his research and making another captains call.. like it or not.. there it is.
