| Where is the problem with them taking legal action? The couple only went ahead with having children by IVF because the hospital assured them they could screen for the genetic disorder so that any child born would not be a carrier of the cancer gene concerned. The hospital screwed up leaving the parents with the pain and expense of caring for a child with a genetic disorder and you've got a problem with them holding the hospital accountable? |

Having read the article this morning, I'm sitting on the fence on this one. Much as I seriously dislike how litigeous we are becoming, I (grudgingly) can see their point.

agree with nj. My only point of contention is, he carries the gene but from what I understand he doesn't have it. Can you sue for potential suffering?

If I was sold a faulty product or given information upon which I relied and it turned out to be 'faulty', surely I have a right to sue for compensation.

Surely the hospital involved would have had them sign a waiver of sorts stating that there is always a possibility of something going wrong.
I'm firmly of the opinion that if they knew they had a defective gene then they should have adopted and not even considered passing their defective genes on. No matter the medical assurances.
I like also the "we need to have a non-defective kid and someone needs to pay for that" tilt that this litigation has.

Do people realise that we are suffering a doctor shortage at the moment? The main reason is the fear of litigation. Imagine working your whole life to build up a comfortable retirement to have it taken away due to something that may not necessarily be your fault - Medicine is not an exact science but the blame will lay with the Medicos should something go wrong.

No, the main reason is the Doctors Union, the AMA capping the number of medicine places at uni, capping the number of specialists to keep their scarcity value (i.e. wages) up. I always found it strange that the previous govt was quite happy to bend over backwards with this union, but 'outlaw' others. |

No, the main reason is that Doctors are preventing more Doctors from being trained.
So that
* there is an artificial shortage
* to keep salaries artificially high
* to maintain political power
It has little or nothing to do with litigation as Doctors have an insurance fund that pays out in damages cases.

This might have something to do with pharmaceutical companies being one of the larger contributors to the liberal party's coffers.....
