Well folks,tomorrow 13/06/02 is my big day.....final day formy work cover case,its infront of the beak and all decisions entered into wont be disputed.
hopefully I will get a good amount of money out of this,BUT is all depends on the outcame.
I shall catch you all on FRIDAY,with a result we hope.

Well folks,I have spent 2 days in the box at court.....nearly lost the case over a doctors report,BUT an old employer of mine told my barrister exactly what he wanted to know and consequently I wont the case.
It is now up to the Judge to allocate compensation to me,whichwill be done after next Tuesday when submissions have to be made.
Take my advise and NEVER go thru court as it is HELL.
To answer any other enquiries,I am suing negligence against my old Courier company employer,for negligence on unloading a 1 tonne load in an unsafe proximaty.I have done my back in,had the operation,BUT have no feeling in my RHS leg or feet.
I was offered $225,000:00 but regected that as it has to last me 5 years and I have to live on that as well as survive.
I am trying to get $365,000:00 plus casts.....we will just have to see what the judge has to say.

With the amount of money they're throwing around public liability cases, you think you'd get the 365 easy.

unfortunately, the common law award of damages for personal injury does not provide for an indexed pension (as in some other countries) and is based on the "once and for all" rule. as greg said, a damages award is designed to place the plaintiff in the position in which the plaintiff would have been had the tort not been committed, including allowance for expenditure incurred in reliance on the defendant's conduct (reliance loss).
often, proceedings under the law of negligence can be expensive and outcomes can be unsatisfactory. that is why, in addition to or as an alternative of remedies in negligence, there are also the following statutory provisions: workers compensation, criminal injuries compensation, social security, no fault motor accident benefits in Vic, Tas and the NT, and sporting injuries in NSW under the Sporting Injuries Insurance Act 1978 (NSW)

Hey Magpie Greg & Junk Boy 75,you are pretty right.
To quote my Barrister.....what you get will have to last you 5years and then IF YOU ARE LUCKY....you will be entitled to a Disability Pension,BUT only if you are lucky.
To answer Browny 26.....dont kid yourself.If I had been in a wheelchair,then I would have been entitled to more,but its only because I won my case against my employer that I am in control of the outcome.
In actual fact with my injury which is lower back,sciatic,RHS leg and foot,I am only entitled to partial payout.All of this payout CRAP is decided on 5 only,and not what you hear on TV.
I am 45% disabled,which works out to about $135,000:00,pain & suffering is 45% which is around $130,000:00,loss of wages past is $30-40,000:00,loss of wages forward is about $100,000:00 and superannuation is NIL.The other Barrister asked me if I was prepared to work part time...my answer was 'who will hire a bum like me at 53,with not being able to drive,not being able to sit for a long period of time and having to walk around for circulation' his answer was....No more questions your honour.
Any way the ball is in my court now and I have to wait until the judges decision within 10 days.
It has been a real eye opener and I hope no-one else has top go thru it....It has mentally and phusically drained myself and the mrs,so when the $$$$$come thru,off we go on our holiday.
