I think Stui posted this a while back. Sadly, he didn't sue because they failed to live up to the literal promise of their slogan, because that would have been hilarious. Crying or Very sad

I'm surprised by this decision. It's clearly a 'sales puff' and therefore the message "Red Bull gives you wings" shouldn't be taken seriously or even literally speaking by a reasonable person.

I learnt this concept of 'puffery' in Contract Law at university and usually companies like Red Bull wouldn't be liable for displaying such a message if it's only intended to for the purpose of advertising rather than guaranteeing a consumer that a certain event will occur if he or she drinks their product. However on a case by case basis the question of whether something's intended to be seriously or is merely a sales puff is determined objectively.

Actually I'm not surprised, I'm mind-boggled by the decision Shocked
