Why stop there MG, let's put a posthumous Robert Menzies on trial too. Think of the number of Germans Australian's killed at his behest during WWII.
I guess too under your rationale Kevin Rudd should be tried. I am sure an Australian soldier has killed since he became PM.

But seriously, Menzies didn't start the war. Even Churchill was only responding to a serious threat to his own country. Bush et al? Harder to say.

Bin Laden has killed many many times more Muslims than Americans/Westerners.
Not sure about the comparison to Saddam, as Saddam was tried and convicted by his political enemies. I think Kilcullen's point would be to demostrate that the 'War on Terror' is not a crusade against Muslims (I will stay away from whether it is or isnt) and more a fight against extremism.

^ yeah, exactly. As you said, it's about allegiances. There seems to be a big "us v them" undercurrent running throughout the middle east, and despite the fact that Bin Laden is a monumental douchebag, you don't want anti-Americans falling for "enemy of my enemy is my friend" rhetoric. As Kilcullen says, he has committed enough crimes against Muslims for him to be legitinately tried in a non-US court, and that would be far more valuable than any US musical puppet show trial.
