Quote:
Yes. In our great land of Aus, there are no laws that criminalise so called “illegal downloading”. That is, you cannot be charged with downloading and watching pirated content for individual use. In fact, recent amendments to the Copyright Act 1968, instead of targeting the individual viewer, have taken aim at the viewer’s ability to access torrent websites. Under those changes, on application by the owner of a copyright (Sony, Village Roadshow, Foxtel etc.) the Federal Court of Australia may grant an injunction to require an ISP (such as iiNet, Optus, Telstra etc.) to block access to a website. The changes have not, however, introduced new criminal or civil penalties for your average Game of Thrones enjoyer with no Foxtel subscription.

Whether there’ll be further laws introduced (and, no doubt, subsequent skirmishes to the Federal Court) to battle the issue of illegal downloading remains to be seen. Perhaps, however, if rights holders such as Foxtel put the same great effort and resources towards evolving with technology and the changing demands of its target market, there would be less need for such legal action.

Agree. IF Foxtel want more $$$ and Customers then don't Rip People Off with it being to Bloody Expensive. So that make People Download there Media for Free.

Interesting they say that for Non-Commerical(Personal Use) there is not law against it

Interesting, though it does raise the question of why it is so often referred to as such and how punitive measures (such as the proposed three strikes policy) could work if the activity isn't against the law. Would be good to see another source on this.

Very Good Point but I guess a ISP could put it in there/your Contract that they can have a 3 Strike Rule

I see, that makes more sense.

Another question is why no Australian government has thought to criminalise it. It might be rarely enforceable, but if nothing else having a statute there would probably help their cause I would have thought.

Though Rupert Murdoch and Graham Burke are trying there best to Change that. Most likely from Bribery

I guess that was directed at Dave, but I'm happy to answer anyway: I download films that I can't easily get hold of through regular means (i.e. shops, video rental stores or streaming services like Netflix). A few things I download are available for sale on Amazon, but I'd rather not spend $40+ on a film I don't even know if I'll like – usually, if I watch it and do end up liking it, I'll buy it anyway afterwards.

I do the same, there are some movies I have downloaded that I cannot obtain on DVD, or at all so I download them. Everything else I have downloaded I have later bought when it has become a bit cheaper and I have had the funds to do so. There are some movies I have chosen to download first to check them out, if they're any good I buy, if not I move on.

I'd be happier paying around 10 dollars for a movie then nearly 30, if they were cheap upon release I'd purchase more than I download.

Agree Cost can play a Role.

Things are getting More Expensive which will lead more People to Piracy.

I get Old Games which are Expensive to buy and Hard to Find
