I'm going to assume the .38 is a DA/SA (double action single action) rather than a DAO (double action only)
The first thing I do is cock the hammer so im shooting in single action mode rather than the heavy trigger pull of double action; this means my first shot is the most accurate; I aim for the shoulder as im less likely to get a ricochet off the hard bone of the head. After the first shot im hoping the impact has shocked the muscles in the arm and they cant make a decent cut. It’s a gamble but the last thing I want to do is give them a gun to kill both of us.
