Wasn't nicks fault at all, it was taken without his consent, and then he demanded it be deleted and was told it was.

And he was the only one who stayed dignified throughout

Decorum, yes. But whether that's the law's job to regulate is quite another matter.

I'm certainly a fan of a law that would prosecute the distributors of 'revenge porn'. But whether people who pass on, say, a naked photo of a celebrity (even if improperly obtained) should receive a criminal conviction is another matter.

There were, for instance, certain photos of St. Kilda footballers that people here linked to. I didn't think much of that behaviour then or now, but the idea of those posters being prosecuted and facing jail time seems way too much.

As I said, I hope that 'malicious' means what a reasonable person would assume it to mean.

On the plus side, though, this might well put a few gossip magazines out of business.

Oh yes there are many other photo's of aussie sports men and women in various state of undress/excitement around. Including one star almost up to his elbow in it at a Bucks Party with a hooker who months later was found dead in a laneway. No connection of course although the star is known as being one of the few high flyers who "just said no" Wink

It's in the Summary Offences Act. In Part 4A. The changes were introduced by the Crimes Amendment (Sexual Offences and Other Matters) Act 2014, Pages 37ff of the Amended Print Explanatory Memorandum explain how the Parliament thinks this will work.

I know that you will know where to find these things but in case anyone else is interested, all of this can be found in http://www.legislation.vic.gov.au/

The current form of the Summary Offences Act can be found in "Victorian Law Today", the amending Act can be found in "Victorian Statute Book" and the EM can be found in "Parliamentary Documents".
