Good thing to see some serious consequences for people who make bad choices.

So-called "sexting" without consent is now an offence in Victoria.

From Monday, anyone who maliciously or deliberately spreads intimate images of another person - or threatens to do so - faces prosecution under two new offences.

The ban applies to intimate images of anyone under the age of 18 as well as images of adults without their consent.

Those who illegally spread such images can be jailed for up to two years.

Those who threaten to distribute them can be jailed for up to one year.

The new laws also introduce exceptions to child pornography offences so those under 18 will not be prosecuted or placed on the sex offenders' register for consensual, non-exploitative sexting.

Attorney-General Robert Clark said it was important the law kept up with changing technology.

"Previously, the law provided only limited protection against malicious distribution of intimate images and this behaviour can cause considerable harm to victims, especially when images go viral," he said in a statement.


Now we just need a little more capacity built into our prison system, provide jobs and improve law and order at the same time.

Sounds fair enough, but I'm concerned about the use of this term 'maliciously'. Does harmful intent need to be proven, or could this apply to all people sharing nude/sexualised images of others? I hope it's the former.

Unless it's a porno magazine or the like, should you be sharing nude or sexualised others? You wanna share your own goodies, good on you, but if you've got a naked pic of your missus on the phone, I would have thought decorum would stop you sharing it, unless of course she thinks it's cool.

I think it's a great law. Protects a hell of a lot of stupid teenagers.

Does anyone know the name of the legislation where this prohibition has been enacted into our law system?

I'm interested in reading this further in more detail.

Decorum, yes. But whether that's the law's job to regulate is quite another matter.

I'm certainly a fan of a law that would prosecute the distributors of 'revenge porn'. But whether people who pass on, say, a naked photo of a celebrity (even if improperly obtained) should receive a criminal conviction is another matter.

There were, for instance, certain photos of St. Kilda footballers that people here linked to. I didn't think much of that behaviour then or now, but the idea of those posters being prosecuted and facing jail time seems way too much.

As I said, I hope that 'malicious' means what a reasonable person would assume it to mean.

On the plus side, though, this might well put a few gossip magazines out of business.

A bit of a quibble but 'sexting' is flirty stuff between consenting individuals, I don't think I'd call sending nude pics of your ex-Missus behind her back to a coworker 'sexting'.

I'm a bit wary of any 'new law' brought in lately because they all seem to have some back door tyrannical effect. David spotted it pretty easily with this one, send those J-Law pics around and wind up in jail. Yeah, no thanks. Best way to avoid your nude pictures getting out on the internet is not to send nude pictures out on the internet.

I agree with the first part—the use of that term makes me, like Jezza, curious to know what this law is exactly—but disagree with your conclusion. Consenting adults should have a right to private transmission of data without their intimate photos or writing being taken and distributed against their will. I'm not sure if this law is the right response to this phenomenon, but I definitely believe that the problem lies with the breach of privacy, not the decision to take such photos to begin with.

This is a "just in case " law. It will still go on. Its just most of us are not really concerned about some bogan from Narre Warren sending this stuff but to protect the fuggin idiots who suddenly become important because they appeared on some reality show. or got a gig on neighbours.

Although "stolen" work like the Nick reiwoldt stuff just goes to show what a bloody idiot he was for evening keeping it and that Zac Dawson is possibly the stupidest person who ever played football.
