Out of curiosity, Jo, what is it about the image that makes it look like impact damage? Is it the shape of the crack/s, or the grey 'hole' in the middle? If the latter, I think those bits flaked off after the initial crack. It's definitely grown since it first happened. _________________ All watched over by machines of loving grace |

David if you do takes pics email them to yourself so they will have a provable date stamp if anything goes to the Tribunal.
As for not all Agents are scum well I guess it depends what side of the fence one sits on.

Ah well I hope you kept the chips, because yes that's exactly why! Looks like when you say drop something on ice, it breaks a piece off, and then it fractures. Really you need the profile pic (impossible!) to see any unevenness in the surface.i know your as honest as the day is long, so I do believe you, But I can see from that pic why they could try for impact damage. Sound like there are a few faults that need rectifying, is it a very old house? And please get the evidence!
And 1061, while it could be a case of which side of the fence, think it's more a case of bad tenants, bad landlords being a part of the landscape in the way of human nature, just like feral/ not feral footy fans. Lack of respect and human decency, it's everywhere. But so is respect and compassion if you look in the right places. Agree with TP - it does "look like" impact damage - but the point being, what are you dropping in the shower that weighs more than 0.8kg or so?? (Roughly the weight of a standard size bottle of shampoo or conditioner.)
Any shower base that's fitted properly and isn't faulty would easily handle this sort of impact if dropped from no higher than about head height (1700mm - 1900mm ish).
So, even if it is impact rather than wear and tear - you are far from liable in most reasonable people's eyes.

I didn't take a photo until yesterday, but the agent did on Friday before last. I think one of the bits hadn't flaked off yet at that point. The crack's definitely gotten bigger, too.
KM, what sort of weight do you think would need to be dropped from head height to cause a crack like that? _________________ All watched over by machines of loving grace |

Depends how even/uneven the surface is. If the bed an acrylic surface on is not supporting the base evenly (ie in all the nooks and crannies that may exists underneath) not much. When you fit the base, you have a bed of slurry, which is runny concrete with small gravel, you sort of slide it around to get all the air bubbles out from underneath, it takes a while to get it right, and get it level. (I helped hubby fit ours, by the third we had it down pat!). But even so, the surface is still a fairly brittle substance, and just like an iPhone screen, it's picky as too what cracks it! I've dropped my three umpteen times, and my new five a few, no cracks, I've seen people drop it the first day and shatter the screen! It's like voodoo! You'd think a soft edge bottle of shampoo would be right, but it could have already had a fault. Either way, if they saw it before those chips came out, I don't think they would fight it at tribunal, they couldn't prove it. And that link I gave you says it cost about 340 to repair, not worth it. My first thought is impact damage. Either Stui has stayed the night and unleashed his elephantitis gonads in your David Gower or you've been shopping at Costco and bought a 10 litre bucket of J&J no more tears and she's hit the floor.

Lucky the next day was the Whittlesea Rodeo, otherwise I would have felt out of place. |

Don't really have a direct answer for you there - but suffice to say that anything used in the course of havin' a tub wouldn't qualify!!
My line of thinking is that the heaviest shower item is a bottle of shampoo; slightly less than a kg when full, rounded edges, soft plastic surface.
If something like that is what they're alleging to have caused the damage - then the quality was not at an acceptable enough standard to begin with.
Counter-claim with an unsafe living standard writ!!!!
(Ahh, probably don't do that - but maybe subtly throw a scent of that sort of attitude in a conversation somewhere and look for a sign as to whether they shit themselves at the thought???? You play poker????)
The biggest revelation here for mine though - is that despite living in Fitzroy, Brunswick and Coburg during your time in Melbourne - you actually use the shower!!!!

Great news: real estate agent and property manager turned up today with a shower specialist this morning. He took one look at it, felt around a bit and said "this hasn't been installed correctly". His opinion is that it's a stress crack and definitely not our fault.
Of course, this doesn't mean that we're out of the woods entirely. They may send someone else in for a second opinion or somehow try to claim that it's still our fault, but, as it is, I think we're pretty safe. _________________ All watched over by machines of loving grace |
