This is a disgraceful decision by the judge.

Let's send him to WA to hear Marley's case. Probably give Marley a knighthood.

The guy who was attacked either has a very hard head or the bloke attacking him couldn't knock the skin off a rice pudding. All those punches and kicks and the guy gets a few cuts and bruises, whereas Marley throws 1 punch and breaks a buys jaw.

The key difference appears to lie in Marley's 'grievous bodily harm' charge, though of course it's still possible that he too could receive a suspended sentence. For me, intent surely has to come into it somewhat—the fact is that the guy could have been killed or left braindead here and it's really just luck that he wasn't. Not sure that the assailant should be given a lesser sentence because of that.

Well they guy in the OP could of being Brain Damged or killed as well

I guess it's likes bumps in the AFL. If you make the decision to beat on someone, you're responsible for the damage done. If that's one punch that does massive damage you'll be up for more than 20 that do little. Except when you're not held responsible like in the David Hookes case.

It's pretty clear though that multiple blows should be treated more harshly, simply for the fact that it takes place over a longer period and leaves more room for thought by the attacker. The damage done to the victim and circumstance of the attack also come into it though (was the fight a two way conversation?).

With the media campaign on this, we do seem to be getting to the point where "one punch" is somehow the worst possible kind of attack, and the defense that: I hit him more than 20 times and gave him plenty of chance to defend himself is just around the corner.

Over here in WA A few years ago a police officer was attacked from behind when trying to break up a pub brawl with a what was said a flying head but which left him paralysed, brain damaged and visually impaired.

The perpetrator was acquitted claiming self defence because his father had been tasered.

The police officer name is matthew butcher if anyone has heard of the case. Just goes to show how pathetic the courts are these days.

I hope Marley gets a suspended sentence but i dont like his chances.

Completely agree. A much more violent act in many respects and, by the law of averages, considerably more likely to result in serious injury (whatever the actual result was in this case).

Taken in isolation, I'm not sure what the penalty should have been. Whatever the case, you clearly want to have some kind of deterrent here.

let's not forgewt he was also unconscious. given the long term effects of brain injury, how can knocking a man unconscious not be considered a serios injury.

This is a little bit of a joke.

It's a bad decision but the perpetrator pleaded guilty and probably showed remorse. Marley did neither. It makes a difference.
