Irrespective of what Hick's is alleged to have done, for a supposed democratic society to charge him under a retrospective law is an absolute fcking disgrace. The reason the Australian government refused to bring Hick's home for trial is because he had not broken any Australian law the was in place at the time of his capture, and even Howard and Ruddock agreed it would go against our democratic values to charge him under a retrospective law. Now all of a sudden the US does this and it's okay according to the government?

Before you chime in with the usual 'ah well he deserves what he gets' think about what it means to be charged under a law that didn't exist at the time of the alleged offence.

At a more practical level, how can you be charged with attempted murder, when the prosecution has already admitted that you have never actually fired a shot?

What hope have you got for a fair trial when the "rules" allow for hearsay evidence.
This means anyone can stand up and say they heard 2nd or 3rd hand that Hicks did something. Never,ever admissible in a court of law in the US or here. But in Cuba.......

Could not agree more - forget the individual, forget the media and the Government PR machine - the principles of a fair and just legal system are the issue - it is difficult to take the emotion out of such a situation - but the principles of a fair and just trial for all are not well served by this decision

John Howard and his Party want him back here now. Not that we have an election coming and the polls are swinging against the detention of David Hicks. Guilty or not guilty he should stand trial and not by some beat up Military Kangaroo Court. The US preaches Truth Justice and the American way only when it suits them.

Personally I have no time for Hick. In saying that I agree there is a principle here and apathetic Australians are starting to wake up to it as well.

lol it's all relative isn't it? I would consider both to be fairly moderate.

Still, the scare tactics call is pretty silly, if anything Rudd is trying to get some of Howard's conservative vote. He may well be succesful in that regard.

Makes you wonder if it might be a good year for the Greens? After all, surely no self-respecting socialist would vote for Kev, unless they just wanted to get Howard out of office.
