If you want to use the recording in a 'court of law' you have to ask permission first, if the party gives permission then no problems.

If you don't ask for permission, it cannot be submitted into court, therefore you can record anyone anywhere without permission, just don't try to use it against them.

My Soliciter told me it was OK to record someone as long as I was on the tape in the conversation as well.

I just can't believe he keeps on using the wrong name. The man is either an Idiot, or thinks he is above the law.

I'd read through the Privacy Act myself if i were you. I'm sure that if you are taping someone you MUST disclose to them that they are being taped.

As most of you know I work as a Subby to a courier company. In November I changed companies on a promise of X amount of dollars per day. December is meant to be the Busiest time of the year for the transport industry so I thought I was in for a very good Xmas. After a few days with company I smelt a rat, I was not getting the work to match what I had been promised as although I was on a minimum guarantee the verbal promise was of much more. I had worked with this company 6 years ago, and some of the office staff remembered me from way back then. 2 weeks after I started I got a call from one of the office staff, nothing unusual about that. Except!!! As I answered remembering this girl would have had to get my Phone Number out of the Computer with all my details right in front of her and I hadn't seen her in 6 years. Anyway as I answered she called me by my former name, now if that wasn't bad enough I heard laughter from a lot of people around her. I just put the phone down on the seat and kept driving.

I arranged a meeting with this companies General Manager and when I rolled up for this meeting the owner of this Company greeted me at the door. He then called me by my former name as well..... with a smile. When I turned and asked him what he said he said in reply... Well (my former name) only you and I heard it.

In a conversation with the General Manager he admitted what had been said, he didn't realise I had my little recorder in my bag.

I have had a few telephone conversations with the owner since not once has he said Sorry and in every conversation he gets my name wrong....

Call me naieve or stupid but I have no idea what this has to do with the Essendon Football Club having discriminating board members.

Pardon my ignorance but is this like not calling Gary Hocking Wiskas? I am not trying to be funny.

EFC put themelves up as one of the most forward thinking Clubs in the AFL. With Beverly O'Connor as the first woman board member of an AFL Club. Would we/they want a man with this attitude on the board of our Football Club?
Oh ok thank's I'm with ya now.

just like some of the small minds on here Tess m8, people think they have the right to force their opinions and values on others, don't let them get to you as that is their intent.
The world would be a far better place if people judged people for WHO they are.

The law has changed in regard to the use of surveillance tapes, both audio and visual.

Lets just say I'm 'him' and you just played the tape back to me.
I would say to you.."so, who gives a ****, what are you going to do now?.. cause I know you can't play it in court, you stupid ass wasting my time mother ******".???......

EBB, "to the person hearing the complaint", not the person taped. Why would you bother playing it to the uneducated fool, he knows what he said.

Tess, That is good knews, keep going matey!!

F4C, you missed my point, eventually the tape will be played back to the 'uneducated fool'.

I simply cut out the red tape. (therefore you get back to my post above)

I don't like discrimination but, I can bet my life that it won’t go much further.

Well that's good news. I didn't want him to turn this around on you. Go with the EOC.
