Post subject: Capturing match replays from AFL.com.au | |

Hi i'm going to make a pies music vid of season 2006.
Ive used WM Recorder to get the link off Bigpond TV, and used ASF capture to capture it. It went through that whole process for a couple of hours but when i open the file it dosnt run.
Any idea? |

Maybe you should first contact the AFL and outline your plans before they get wind of it and nail you for breach of copyright.
And you're using Nicks to openly inform everyone what you are doing! |

saves .wmv files that Windows Media Player can open no problem |

Under the Copyright Act, it's only copyright infringement if you make an unauthorised copy of the "whole or a substantial part of" a work.
It gets very technical whether this a breach of copyright or not because you need to determine whether the streaming video is a "broadcast" or a "cinematograph film". If it's a broadcast, then copyright subsists in respect of each and every still image. A "film" on the other hand, is the aggregate of each frame in the film. The result is that to breach copyright in a broadcast, all you need to do is copy a single frame but to breach copyright in a film you need to copy the whole or a substantial part of it.
Now, firstly format shifting under Australian copyright law is a form of unauthorised copying.
I would have thought streaming video is akin to a broadcast, so in other words, you can't even capture a few seconds of video without it being a breach of copyright. Each frame has its own copyright, so copying one frame is in effect copying in "whole or a substantial part".
On the other hand, if you legitimately bought a DVD from the AFL, this is more like a film so capturing some highlights from it would in my opinion not be a breach of copyright. The copyright only subsists in the aggregate of the still images encoded on the disc and it would only be a breach if a whole or substantial part of that was copied.
This is the precise issue that came up when Channel 9 sued Channel 10 in the Federal Court for using Channel 9 clips on the Panel. The difference there was that Channel 10, as a news reporter, has a defence under the Copyright Act for fair reporting of news. At the moment under Australian law there is no defence for personal fair use, but this may change in the next year or so to bring us into line with the less strict US approach.

well the tv stations obviously do care.
the attorney-general is trying to amend the copyright act so that private copying for personal use is a defence to copyright infringement. However, broadcasters have put in some very powerful submissions opposing any change.
it would be well within the rights of bigpond as broadcast licensee or the afl as copyright owner to either go after Nicks for publishing links to copyright material, which could be easily construed as copyright infringement or alternatively, obtain names of nicks users who engage in copyright infringement.
while tv stations obviously can't sue everyone for what they do on their vcrs, if you think it doesn't happen in the online environment, you're an absolute muppet. ISPs get requests all the time to hand over details for copyright infringement issues - very minor ones. _________________ Go Pies!!! |
